Approval of Patent Term Extension in Russia

Different cultures think and feel differently about the renewal of patents. Although some countries do not feel comfortable granting patent extensions, others make exceptions for some types of products. In countries that patent terms can be extended foreigners cannot get very far with their renewal if they fail to render professional patent translation services. What falls under the category of products whose patent terms can be extended is narrowly defined by the Patent Term Extension regulations. Foreigners must be very clear about the definitions of the terms and be confident about their chance of receiving an extension.

For example, the translations of drug descriptions have to perfectly explain the effects of the medication on the human body. If the meaning is off the translator did not do a great job providing patent translation services and Russian officials may no longer consider the product in the category of items whose patents can be renewed. In Russia there are no limitations on the number of patents one can file. However, when foreigners want to register with the PTE they have to submit several documents. Every piece that will be submitted to the MOH has to be officially translated into the Russian language. The patentee has to submit a document that proves the formula that has been approved is the same as the patented substance. The translator who executes patent translation services can also undertake the task of translating package inserts or an excerpt from the Medical Guides. Such documents can serve as sufficient proof of identical formulas.
