Not patentable in China

American biotech companies like Gilead Sciences that are interested in obtaining intellectual property rights protection in China will be surprised to learn China’s patent laws. In China neither techniques for treating a disease nor pharmaceutical salts are patentable. Prior to seeking patent translation services for the documents that they will be asked to submit to authorities, American entities should learn Chinese laws. If the methods that they have in mind are not patentable in China investing in patent translation service would not be a productive use of resources. They can remove language barriers and expand their knowledge of patent laws in the country they want to expand their operations in.

Knowing a little bit about China’s intellectual property laws often saves such organizations time and money. Applicants who wish to patent a method are left with the option of registering compounds or compositions. In a recent case the Chinese Patent Re-Examination Board refused to grant intellectual property rights protection to an American biotech company for Tenofovir Disoproxil Fumarate, which is an active ingredient in a drug that treats diseases such as HIV and hepatitis B. The Re-Examination Board has based its decision on the idea that this active ingredient’s role is not different from other substances that have already been patented. It merely facilitates the absorption of the compound, a characteristic that is not sufficient by itself for IP rights protection. Foreign biotech companies that believe they can register their patents in China should make sure that the translations of their documents are accurate and easy to read.
